Terms of Service

Please read these Terms of Service ("Terms") carefully. These Terms constitute a legally binding agreement between you ("Customer", "You") and SensoCAN ("Company", "We", "Us") governing your use of the SensoCAN IoT platform, API, and associated services (collectively, the "Service").

Important Notice

By accessing, registering for, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Scope of Service and License

Subject to these Terms and payment of applicable fees, SensoCAN grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal business purposes to monitor, manage, and analyze your authorized IoT devices and telemetry data.

2. Strict Hardware and Safety Limitations (Mission-Critical Systems)

Not for Life-Safety or Critical Infrastructure. The Service relies on third-party networks, internet connectivity, and external APIs, which may be subject to latency, interruption, or failure. You explicitly acknowledge and agree that:

  • The Service is NOT designed, intended, or authorized for use in life-saving, life-sustaining, medical, nuclear, aviation, or mission-critical industrial applications where a failure or delay could result in personal injury, death, or severe environmental / property damage.
  • SensoCAN assumes absolute zero liability if the Service is used in such environments against these Terms.

3. Automated "Rule Chains" and Device Actuation Liability

The Service includes features that allow you to configure automated "Rule Chains" or trigger remote actions on your physical IoT edge devices based on telemetry thresholds or AI heuristics.

You are solely responsible for the logic, safety bounds, and physical consequences of any automated commands dispatched to your hardware. SensoCAN provides the software execution layer but is not responsible for any physical damage, hardware failure, production loss, or liability resulting from automated actions configured within the platform.

4. Data Ownership and Stewardship

4.1 Customer Data

You retain full and exclusive legal ownership of all IoT sensor data, telemetry, and configuration logs you stream to the platform ("Customer Data"). SensoCAN does not claim ownership of your Customer Data.

4.2 SensoCAN's License to Process

You grant SensoCAN a limited, worldwide, non-exclusive license to ingest, compute, and temporarily store your Customer Data strictly for the purpose of providing the Service to you (e.g., generating dashboards, running your rule chains, executing queries).

4.3 AI Processing and Data Separation

SensoCAN may utilize third-party Large Language Models (LLMs) via APIs (e.g., OpenAI, Anthropic Claude) to power the "Conversational AI" and analytical features. SensoCAN guarantees that your Customer Data is strictly separated. Your proprietary, identifiable telemetry data is never used by SensoCAN or its third-party sub-processors to train foundational or public AI models.

5. Acceptable Use and API Limits

You agree not to misuse the Service. Specifically, you shall not:

  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Resell or sublicense the Service to third parties without an explicit reseller agreement.
  • Use the Service or API in a manner that exceeds reasonable request limits, constitutes a Denial of Service (DoS) attack, or intentionally degrades the performance of the platform. SensoCAN reserves the right to throttle or suspend connections from edge devices that violate API rate limits or threaten platform stability.

6. Limitation of Liability and Warranties

"As Is" Basis. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SENSOCAN BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, COMPROMISED HARDWARE, OR PRODUCTION DOWNTIME, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

7. Termination and Suspension

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms or non-payment of fees. Upon termination, your right to use the Service will immediately cease, and your Customer Data will be securely purged in accordance with our Privacy Policy.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice of any material changes via email or an in-app alert. What constitutes a material change will be determined at our sole discretion.
